China Embassy Attestation: Why Indian Documents Still Need the Embassy Route

China joined the Apostille Convention in 2023, yet an Indian Apostille is still not valid there. India objected to China's accession on 8 September 2023, so the convention does not apply between the two countries. China embassy attestation therefore remains the route: a red-sticker notary, state or Chamber of Commerce authentication, MEA attestation, and legalization by the Chinese Embassy or consulate in India.

Quick answer

Can I use an MEA Apostille for China? No. Because India objected to China's accession to the Apostille Convention, an Apostille from India has no effect in mainland China. Indian documents need China embassy attestation: notarisation with the red sticker, state or chamber authentication, MEA attestation, and then legalization by the Chinese Embassy or the consulate covering your state. Hong Kong follows a different, Apostille-based route.

Why the Apostille Does Not Work for China

The Apostille Convention lets a member country object when another country joins. If it does, the convention does not operate between those two countries. India lodged such an objection to China's accession on 8 September 2023. China's membership therefore made no difference to Indian documents.

Some agents still offer an Apostille for China. A Chinese office will not accept it. Ask for the full embassy route from the start. For the general structure of that route, see our embassy attestation guide.

China Embassy Attestation Step by Step

  1. Notary with the red sticker. Many documents for China are first notarised, and the notary's red sticker becomes part of the authentication chain.
  2. State or chamber authentication. Degrees go to the state education department. Birth, marriage and PCC documents go to the home or GAD department or the notary and SDM route. Company and export papers go to a recognised Chamber of Commerce.
  3. MEA attestation. The MEA stamps the document. This is an attestation stamp, not an Apostille.
  4. Chinese mission. The Chinese Embassy in New Delhi, or the consulate whose area covers your state, legalizes the document.

Work Permits for Professionals

Indian engineers, teachers, managers and technicians hired in China usually apply for a work permit and a work visa. Chinese authorities commonly ask for a legalized highest degree and a legalized criminal record certificate. In India, the criminal record certificate is the police clearance certificate.

Both papers go through the full route above. Plan the PCC attestation early, since the PCC itself must be issued first and some employers want it to be recent.

Export and Company Documents

India sells cotton yarn, chemicals, ores, pharmaceutical ingredients and seafood to China, and many Indian firms buy machinery and electronics from there. Chinese buyers, banks and registration offices may ask for legalized commercial papers. Common ones are the certificate of incorporation, power of attorney, board resolution, certificate of origin, commercial invoice and free sale certificate.

These are notarised where required, authenticated by a Chamber of Commerce, attested by the MEA and then legalized by the Chinese mission. Read our commercial documents page for the chamber step.

Students and Families

Indian students enrolling in Chinese universities may need legalized school or degree certificates and a birth certificate. Families joining a worker in China often need legalized marriage and birth certificates for residence permits. A registrar-issued certificate is the safest starting point. See our marriage certificate page for the state step.

Chinese Translation

Chinese offices work in Mandarin. Many ask for a Chinese translation of each legalized document, sometimes prepared by a translation company in China. Where a translation from India is accepted, we can arrange Chinese translation. Translate the final legalized document so that every stamp is covered.

Chinese names for Indian companies and people are not standard. Use one Chinese rendering of your name or company name and keep it identical on every translation.

What to Send and Common Errors

  • Original degree or certificate, unlaminated
  • Passport copy
  • For company papers: signed and stamped copies on letterhead
  • The Chinese employer's or buyer's instruction letter

Errors we see: paying for an Apostille for China, skipping the notary step, and sending papers to Hong Kong and mainland China under one route. We quote per document in writing before you send.
