United States Apostille for Documents From India

A United States apostille is issued in India by the Ministry of External Affairs (MEA) and is the accepted way to legalize an Indian public document for use in the US. Many US processes never ask for one, though. Immigration filings, university admissions and credential evaluations often run on copies or on records sent directly by the institution.

Quick answer

Do I need an Apostille on Indian documents for the USA? Only if the US office, court, bank or school asks for it. When it does, the United States apostille is issued by MEA after verification by a state department, notary and SDM, or Chamber of Commerce. No US Embassy step follows. Check your instructions first, because many US applications rely on copies or direct verification.

When a US Body Actually Asks for It

People often apostille documents for the US out of caution and then find nobody wanted the sticker. Federal immigration forms usually ask for copies of civil documents and translations, not apostilles. Credential evaluators commonly want records sent straight from the university. Universities may do the same.

The Apostille is more often requested by US courts, state licensing boards, county recorders, banks handling estates, and companies dealing with Indian entities. Read the request carefully. If it says "apostille" or "legalized", follow the route below.

Teachers, nurses and other licensed professionals are a frequent exception. Some state licensing boards ask for apostilled degrees, registrations or experience letters. Check your board's current rules, because they differ from state to state.

United States Apostille Process in India

  1. Degrees and transcripts: state education department, or notary and SDM.
  2. Civil papers and affidavits: state Home or General Administration department, or SDM.
  3. Commercial papers: notary where needed, then a recognised Chamber of Commerce.
  4. MEA Apostille through an authorised outsourced centre in New Delhi.

After this, the paper is ready for the US.

MEA verifies only the officer's signature. It does not check or correct the content, so fix spelling errors at the issuing office first. A United States apostille on a wrong certificate is still a wrong certificate.

Marriage and Birth Papers for Families

Some US processes, such as name changes, state registrations or school enrolment, may ask for apostilled birth certificates or marriage certificates. Use registrar-issued certificates with names matching passports. Where a birth certificate lacks a name, get it updated at the municipal or panchayat registrar first.

Indian Companies and US Partners

Indian companies opening US subsidiaries, signing distribution deals or registering with US agencies may be asked for an apostilled certificate of incorporation, board resolution, power of attorney or commercial documents. Exporters may need a certificate of origin or free sale certificate apostilled for a buyer. All of these pass through a Chamber of Commerce before MEA.

Translation for US Use

US offices work in English. Papers in Hindi or another Indian language need a complete English translation, often with a statement from the translator about accuracy. Our translation desk can prepare it.

Death Certificates and Inheritance Cases

When a family member dies in India and leaves US bank accounts, retirement savings or property, US banks and courts may ask for an apostilled death certificate, legal heir certificate or succession certificate. Death and legal heir certificates are verified by the state Home or revenue department before MEA. Court-issued succession certificates may need a certified copy from the court. Each paper gets its own Apostille.

Ask the US bank or attorney for the exact list before starting. Estate cases often add documents along the way, and doing them together saves a second round of courier.
